This document is intended to define the rights and obligations between the "BoomAI" application (hereinafter referred to as "this application") and its subscribers (hereinafter referred to as "users") regarding the user's selection and enjoyment of the continuous payment authorization deduction service (hereinafter referred to as "the service") provided by this application. This document details the responsibilities and rights of both parties in the use of the service and its related aspects.
"User" refers to any individual or single entity who enjoys the exclusive subscription service provided by this application. This document serves as the basic condition for users (individuals or organizations) to use the various services of this application. Those who do not accept the terms of this document will not be able to enjoy the service. Once the user selects and activates the service, it means that he/she fully accepts and agrees to be bound by all the terms and conditions in this document.
2. Description of Services2.1 Based on the user's demand for the convenience of continuous payment, this service came into being and is provided exclusively for users who have enabled this function, in order to avoid the inconvenience and loss caused by failure to renew in time due to forgetfulness or other factors. The user specifically grants this application an irrevocable authorization, allowing the subscription fee for the next billing cycle to be automatically deducted from the user's pre-bound and confirmed valid self-owned recharge account or the bank card associated with it (hereinafter collectively referred to as the "payment account") when the user's qualification is about to expire. The implementation of this service depends on the user's successful binding of his or her subscription account for this application with the above-mentioned payment account, and ensuring that this application has the ability to successfully deduct funds from these accounts.
2.2 Based on the terms of 2.1, continuous payment means that the App automatically charges the subscription fee for the next subscription billing cycle through the payment account pre-designated by the user (including the user's own recharge account and bound bank card). The user is responsible for ensuring that there is sufficient balance in the account for deduction. If the renewal fails due to insufficient account balance, the consequences and responsibilities will be borne by the user.
2.3 Users shall fully comply with the provisions of this document during the use of this service. Any use of the service through this application shall be deemed as the user's explicit acceptance and agreement to the terms of service and all announcements and instructions issued by this application for this service.
2.4 This service is limited to legal use by users on the official platform of this application. Any attempt to separate the service content from the software platform through illegal means (such as malicious cracking) is not within the scope of the service defined in this document. All legal consequences caused by such behavior will be borne by the actor. This application reserves the right to pursue legal liability against violators in accordance with the law.
2.5 As subscription services are virtual products, you will enjoy the subscription benefits after completing the purchase, and you also have the freedom to decide whether to continue to enjoy this service. Please note that unless this application is unable to perform normal subscription service obligations, your active cancellation of the purchased subscription service or termination of your subscription status will be deemed as a waiver of the right to request a refund of the paid subscription fee and any form of compensation or indemnity.
2.6 After becoming a subscriber of this application, you will enjoy various subscription privileges determined by the latest subscription rules published by this application. In order to continuously optimize the subscription experience and promote business development, this application reserves the right to adjust the content of subscription benefits, which may involve changes in all or part of the benefits. We will promptly inform you of any adjustment of subscription benefits by posting a notice or announcement on the subscription service page. You can easily check the latest subscription rules through this application to obtain the most accurate subscription benefits information. We recommend that you review this document and subscription rules regularly to ensure that your rights and interests are fully protected.
2.7 The effective duration of the subscription service will be strictly based on the subscription period displayed on the page when you purchase and confirmed by you. Once the service period expires, this application will no longer continue to provide subscription-exclusive services and support, and the corresponding subscription privileges will automatically terminate.
2.8 The pricing strategy of this application subscription service, including subscription type, price setting and corresponding benefit allocation, is based on our independent operation plan and is clearly displayed on the subscription service purchase interface. If you continue to perform relevant operations (such as confirming purchase, completing payment, enjoying subscription services, etc.), it means that you have fully understood and accepted the charging standards set by us.
2.9 As a subscriber, you may encounter differences in actual subscription benefits or service content due to differences in the software version, operating system, etc. used by you. We understand that this may cause you inconvenience and apologize for this. You have clearly expressed your understanding of this situation and agree not to pursue or require this application to bear any responsibility for it. To optimize the experience, we recommend that you try to upgrade this application or operating system to the latest version, or directly contact our customer service team for help.
3. Rights and obligations of both parties3.1 This application will provide subscribers with a convenient way to check the detailed cost of continuous paid services. However, this application does not provide printing and mailing services for invoices for the time being. Please understand this.
3.2 After the subscriber authorizes, this application will deduct the subscription fee for the next subscription period from the payment account designated by the subscriber. The deduction operation will be carried out immediately and updated to the subscriber's payment record at the same time, and the validity period of the subscriber will be automatically extended.
3.3 If there is an error in the deduction process, this application and the subscriber should work together to find out the root cause of the problem. Both parties will bear the corresponding responsibility for the losses caused by their respective faults; if the error is caused by both parties jointly and unequally, the responsibility will be shared according to the fault ratio; if the responsibility is determined to be borne by both parties, the loss will be shared equally by both parties.
3.4 This application reserves the right to adjust or revise the service content, rules and specific terms in this document according to business development needs or technical updates. Before making such changes, we will clearly display the modified content on the relevant pages of the software, but will no longer send individual notifications to each subscriber. If the subscriber disagrees with the modification of the document, he or she may choose to terminate the service he or she has enjoyed and stop using this application; otherwise, if the subscriber chooses to continue using it, it will be deemed that he or she fully accepts and agrees to all the updated contents of this document.
3.5 The subscriber can decide whether to cancel the service. If the subscriber does not choose to cancel, it will be deemed that the subscriber agrees to the application to make irregular automatic deduction attempts according to the established rules. Once the deduction operation is successfully completed, the application will automatically renew the subscription service for the subscriber for the next subscription cycle.
3.6 If the price of the subscription service of this application changes during or before the execution of continuous payment, the system will deduct the fee based on the latest price currently in effect.
3.7 This application currently does not charge additional fees for enabling this service for subscribers, but reserves the right to independently decide whether to introduce a charging mechanism for this service itself, adjust the continuous payment cycle or fees in the future based on business operation needs, market conditions and other factors, and all changes will be publicly notified to subscribers through relevant pages.
3.8 You acknowledge and accept that: for the selected payment channel, you are responsible for ensuring that there is sufficient balance in its account to support the normal operation of the service. If the service cannot be carried out smoothly due to any reason such as insufficient account balance or inability to meet service requirements, this application reserves the right to temporarily suspend your subscription service without additional notice.
3.9 After purchasing the subscription service, the user should keep it properly and use it reasonably. The user shall bear all responsibility for all consequences caused by personal negligence or improper use. In this case, this application reserves the right to independently judge and take corresponding measures, including but not limited to suspending or terminating the user's subscription qualification.
3.10 Users are strictly prohibited from obtaining or purchasing subscription services through illegal means such as theft, exploiting technical loopholes, or on illegal sales and transfer platforms that are not officially authorized by this application. Once such violations are discovered, this application will immediately cancel the user's subscription qualification, and all losses caused by this will be borne by the user, and this application will not bear any responsibility. For subscription accounts and their rights involved in illegal behavior, this application has the right to take corresponding measures and reserves the right to pursue relevant legal responsibilities in accordance with the law, including:
3.10.1 This application reserves the right to freeze or terminate your subscription at any time, and in this case, no compensation or refund of subscription fees will be provided.
3.10.2 If your subscription is revoked due to the above violations, you will lose all subscription-exclusive discounts, value-added services and all subscription rights.
4. Validity period and termination of the agreement4.1 This Agreement shall be legally effective from the time when the subscriber chooses to accept or starts to use the service, and shall not be terminated until the subscriber actively terminates the service or cancels the subscription.
4.2 The subscriber has the right to terminate the service at any time through the subscription account settings. Once terminated, this application will no longer provide the subscriber with the various functions of the service.
4.3 Before the subscriber actively chooses to terminate the service, the set continuous payment instructions remain valid. This application will deduct the money according to this instruction, and the deducted fees will not be refunded. The subscriber shall bear the relevant responsibilities arising therefrom.
5. Liability for Breach of ContractWhen either party breaches the agreement, the non-breaching party reserves the right to seek corresponding compensation based on the dispute resolution mechanism agreed upon in advance by both parties.
